Lernin Driving School is a trading name of Lernin Limited, a registered company in England. Company registration number: 15103586.

Personal data and/or information that you provide to Lernin Driving School and/or your Instructor may be used in accordance with our Privacy Policy, available on our website. Your details will not be forwarded without your consent, except for integration with the TotalDrive app, which has its own privacy policy.

Lernin Driving School provides instructors and vehicles for the purpose of driving instruction in line with the DVSA code. Instructors may be either Approved Driving Instructors (ADIs) or instructors in training under the supervision of the head instructor. There is no difference in the quality of training provided. All instructors are insured with comprehensive policies for tuition and public liability.

Driving Lesson Terms & Conditions

By booking lessons through Lernin Driving School or the TotalDrive App, you confirm that you have read, understood, and agreed to these Terms & Conditions. All pupils must acknowledge these terms prior to booking.

  • All Lernin Driving School instructors are self-employed and operate under the Lernin Driving School brand.

  • Lernin Driving School is not liable for any payments not made directly to Lernin Driving School.

  • Pupils must be at least 17 years old. Pupils aged 16 with a valid licence are not covered under our insurance and will not be onboarded until their 17th birthday.

  • Pupils must hold a valid UK driving licence and provide a DVSA check code prior to their first lesson.

  • Pupils must immediately notify their instructor of any new endorsements.

  • Licence photos must bear a true likeness to the holder.


First Lesson Payment Policy

All first-time pupils are required to pay the full cost of their first lesson in advance at the time of booking. This payment is non-refundable, except when rescheduling with at least 5 days’ notice.

This deposit:

  • Confirms commitment

  • Secures the lesson slot

  • Is not transferable to another date unless 5 days’ notice is given

This policy is in place due to short-notice cancellations and no-shows that disrupt lesson availability for other pupils.


Subsequent Lesson Payment Policy

  • Payment for all subsequent lessons must be made at least 36 hours in advance.

  • Lessons booked within 24 hours of the start time must be paid for within 30 minutes of booking.

  • Lessons not paid for in time may be automatically cancelled by the system.

  • Card Payments: via the TotalDrive App (subject to app-controlled fees) or by contacting us directly (1.6% transaction fee applies)

  • Cash is not accepted

  • A digital receipt will be issued for every payment


Lesson Duration & Scheduling

  • Driving lessons are a minimum of 2 hours in duration.

  • Instructors and pupils must agree the duration of lessons in advance.

  • If the full lesson cannot be delivered for reasons outside the instructor’s control, the remaining time will be rescheduled.

  • Instructors reserve the right to rearrange lessons at short notice due to mechanical breakdown or emergencies.


Cancellation Policy

  • Cancellations made with less than 24 hours’ notice will be charged in full.

  • The first lesson payment is non-refundable, unless 5+ days’ notice is given to reschedule.


Eyesight, Drugs & Safety

  • Pupils must pass the DVSA eyesight check. Random eyesight checks will be conducted.

  • Instructors will cancel lessons without refund if the pupil fails the eyesight check.

  • Instructors may cancel any lesson if they suspect the pupil is under the influence of drugs or alcohol.

  • Any suspicion of use of controlled substances (e.g. cannabis, heroin, cocaine) may result in permanent termination of instruction.


Conduct, Liability, and Test Use

  • Instructors will endeavour to teach to the DVSA syllabus and promote safe driving.

  • Lernin Driving School is not liable for actions taken by pupils when unaccompanied.

  • Instructors are not liable for third-party damage caused by pupil negligence.

  • Driving tests must be agreed in advance and added to the diary by the instructor.

  • Instructors reserve the right to refuse the use of the car for a test.

  • Use of a vehicle for a driving test is charged at £150 and includes a warm-up, the test, insurance, and drop-off.


Test Centre Policy

  • Tests will only be supported at Chingford, Loughton, and Wanstead test centres unless pre-agreed.

  • Pupils must not add tests to the diary — these will be removed.

  • You must confirm instructor and car availability before booking a test.

  • Pupils are not under instruction during a test, and DVSA examiners are considered observers.


 Test Booking Policy Clause

With a students permission, Lernin Driving School may book your practical driving test on your behalf. The test will be booked in your name and paid for at the standard DVSA rate — currently £62 for weekday tests or £75 for evenings/weekends.

Lernin Driving School does not charge any admin fees for this service.

Payment for the test and vehicle use is required no later than 14 days before your test date and time. The total cost is:
• £150 for vehicle use on the day of the test
• Plus £62 or £75 for the DVSA test fee (depending on slot)

If payment is not received by the 14-day deadline, Lernin Driving School reserves the right to amend or transfer the test booking to another student who is ready to test and would benefit from an earlier slot.

If another student agrees to take over your test slot, they will be required to pay the £150 vehicle use fee plus the DVSA test fee within 60 minutes. If not, the test may be offered to another student.

No cancellations or test swaps will be processed within 11 days of the test.

If you wish to cancel your own test, you may do so by logging into the DVSA booking portal. As of July 2025, the DVSA requires a minimum of 10 clear working days’ notice to issue a full refund. If cancelled in time, the DVSA will refund the test fee to Lernin Driving School. You will not be charged, and the test slot will return to general availability.

Lernin Driving School does not use short-notice test booking apps or third-party test resellers.

If you independently book a short-notice test and it clashes with a lesson or another pupil’s test already in the diary, that existing booking will take priority.
We will be unable to take you to the test unless the slot has been discussed and agreed with your instructor before confirmation.


DVSA Cancellations

  • If the DVSA cancels a test with less than 3 days’ notice, a refund may be claimed directly from the DVSA.

  • In this case, the £150 flat rate is converted to a 2-hour lesson charge to align with DVSA reimbursement.

  • Any other scheduled lessons are subject to Lernin Driving School’s normal cancellation policy.


Lesson Gaps & Notifications

  • Pupils are notified via the TotalDrive App about last-minute lesson gaps.

  • These are offered on a first-come, first-served basis.

  • Pupils must enable notifications in the app. WhatsApp is used only as a backup.


Gift Vouchers

  • We do not currently operate a physical gift voucher scheme.

  • Hourly lesson credit can be purchased and applied to a pupil’s account by contacting us.


TotalDrive App Terms & Privacy

  • TotalDrive is a third-party app provided at no cost to pupils.

  • Pupils are responsible for enabling notifications.

  • Lernin Driving School is not responsible for premium features (e.g. Theory Test prep).


Refund Policy

  • Refunds will be issued for unused lesson credit where the pupil discontinues training.

  • Refunds will be processed within 28 days.

  • If you received a discounted rate, refunds are calculated at the standard hourly rate (£35 Manual / £38 Auto).


Complaints

To make a complaint:

  • Email info@lernin.co.uk with full details.

  • If your lessons were with an independent instructor under our banner, we may need more information to investigate.

  • If unresolved, we will advise you how to escalate to an external body.


Sexual Harassment & Inappropriate Conduct

  • All instructors are DBS-checked and must declare any relevant allegations or convictions.

  • We investigate all complaints thoroughly and may terminate the instructor’s affiliation.

  • Instructors may use physical contact to avoid collisions where necessary and will brief pupils on this safety protocol.


Appeals

To appeal a decision:

  • Submit your appeal by email within 10 working days.

  • We will respond with either a revised decision or reasons for upholding the original.

  • If unresolved, an external review will be arranged.
